Privacy Notice: What Publishers Need to Know
Mediavine has introduced a privacy notice that appears when visitors from California, Pennsylvania and Florida access your website.
It lets them know that your site and its partners use cookies and similar technologies, and continuing to use the site means they consent to this. The notice adds transparency for visitors in those states.
The notice is enabled by default for all publishers. You can turn it off at any time in your dashboard under Consent Management. Either way, keep your existing privacy settings and disclosures in place:
- Review your Privacy Policy to make sure it accurately describes how your site collects and uses data.
- Make sure any required privacy controls are active, such as opt-out links, consent tools and other disclosures.
- Understand your obligations. Requirements vary by location and by the kinds of data your site collects.
This notice may not prevent legal claims, and Mediavine can’t guarantee it satisfies any state’s requirements or the requirements of your situation. Mediavine is not responsible for how you use the message. Please consult your legal counsel with questions about your obligations.
What Is the Privacy Notice? The privacy notice is a message displayed to visitors when they arrive at your site. Mediavine’s notice explains that the site and its partners use cookies and similar technologies for site functionality, tailored advertising and analytics.
It also encourages visitors to review the website’s Privacy Policy for more information about how their data is collected and used.
What Will Visitors See?Visitors from California, Pennsylvania and Florida will see the privacy notice once per browsing session. Visitors who return later will see it again. The notice reads:
This site and its partners use cookies and similar technologies to collect, use and disclose your site interactions in order to enable site functionality, provide tailored advertising, and perform analytics. By accessing or continuing to use this website, you consent to this. You can learn more about this and similar practices in this website’s privacy policy.
The notice is intended to inform visitors that their data is being collected and to direct them to your Privacy Policy for more information.
How Does the Privacy Notice Work With Your Existing Tools? The privacy notice appears only to U.S. visitors in California, Pennsylvania and Florida. Visitors in the EU, UK and other locations won’t see it.
The notice adds to your current setup and doesn’t replace any required disclosures, opt-out options or consent tools. Which requirements apply depends on where your visitors are located:
- United States: Many comprehensive state privacy laws generally follow an opt-out approach for certain data processing activities, including targeted advertising. Depending on the applicable law, publishers may need to provide disclosures, opt-out mechanisms and other privacy controls.
- European Union and United Kingdom: Non-essential cookies and similar technologies generally require consent before they are used, subject to applicable exceptions and legal requirements. Your existing consent tools for these visitors stay the same.
A general privacy notice does not replace the consent mechanisms or opt-out options required by applicable laws.
How the Privacy Notice Works- Default setting: On. You can turn it off at any time in your dashboard under Consent Management, in the setting called “Privacy Notice.”
- Who sees it: Visitors in California, Pennsylvania and Florida. Visitors whose location can’t be determined won’t see it.
- How often: Once per browsing session. A session ends after 30 minutes without a page load on your site, so the notice shows again on the visitor’s next page view.
- What it looks like: A small bar at the bottom of the screen. It fades on its own after 5 seconds, with no buttons or links, and doesn’t interfere with your content or ads.
- Wording: Mediavine sets the Privacy Notice wording, and it can’t be customized.
Frequently Asked Questions
Will the Privacy Notice replace my existing privacy settings?
No. The Privacy Notice is intended to provide additional transparency about cookies and similar technologies. It does not replace required privacy disclosures, opt-out mechanisms or consent management tools.
Will the Privacy Notice require U.S. visitors to opt in to personalized advertising?
No. The Privacy Notice is not intended to introduce a universal opt-in requirement for U.S. visitors. The applicable requirements depend on the visitor’s location, the activity involved and relevant privacy laws.
Does the Privacy Notice guarantee that my site complies with privacy laws?
No. The Privacy Notice is one part of a broader privacy approach. Publishers remain responsible for understanding and meeting the legal requirements that apply to their websites, including requirements related to disclosures, consent, opt-outs and other data collection activities.
Do I need to make changes to my website now?
No action is needed to turn on the Privacy Notice. It’s enabled by default, so you don’t need to do anything to turn it on. Keep your existing privacy settings and disclosures in place. If you’d prefer not to display the Privacy Notice, you can turn it off at any time in your dashboard under Consent Management.
We recommend reviewing your current privacy practices to ensure they remain up to date with applicable requirements.
